Debt Ceiling – On May 31, the House passed the Fiscal Responsibility Act of 2023 (H.R. 3746) by a vote of 314-117. On June 1, the Senate passed the legislation by a vote of 63-36. On June 3, President Biden signed the bill in law. The law raises the debt ceiling until January 1, 2025, and includes spending caps, claws back unused COVID-19 relief funds, among other provisions. Medicare & Medicaid –

  • On May 30, HHS Office of Inspector General (OIG) released a report on Medicare payment for physician services furnished to enrollees while they were inpatients of a skilled nursing facility (SNF) or hospital. Report in Brief Report
  • Also on May 30, CMS released the latest enrollment figures for Medicaid and CHIP. As of February 2023, 86,174,094 and 7,199,700 people are enrolled in Medicaid and CHIP, respectively. Enrollment Figures
  • On May 31, CMS released a final rule removing the staff and patient COVID-19 testing requirements for long term care facilities. Rule
  • On June 1, Sen. Van Hollen (D-MD) and 15 other Senators sent a letter to HHS Secretary Becerra and CMS Administrator Brooks-LaSure asking the Administration to support state-level “Easy Enrollment” initiatives, which enable uninsured low-income families to sign up for health insurance when filing their state income tax returns.   • Also on June 1, CMS announced its plans to ensure access to drugs that may slow the progression of Alzheimer’s disease covered by Medicare. Press Release
  • On June 2, CMS announced that Utah submitted a request to amend its section 1115 demonstration to provide twelve months of extended Medicaid coverage to certain postpartum women. The comment period is open through July 2, 2023. Pending Application Comments

  • On May 30, CMS released an evaluation report for the Maternal Opioid Misuse (MOM) model, which addresses fragmentation in the care of pregnant and postpartum Medicaid beneficiaries with opioid use disorder (OUD) through state-driven transformation of the delivery system surrounding this vulnerable population.   • On May 31, ONC published a blog on findings in the 2022 American Health Association (AHA) Information Technology Supplement survey. Castor (D-FL) introduced the Advancing Student Services in Schools Today (ASSIST) Act (H.R. 3761), which would provide for an increased Federal medical assistance percentage for State expenditures on certain behavioral health services furnished under the Medicaid program.
